Newsflash – USCIS Announces Filing Fee Increase -- Effective Dec. 23, 2016

Today, U.S. Citizenship and Immigration Services (USCIS) announced a final rule published in the Federal Register increasing filing fees for most immigration applications and petitions, including Form I-129, Form I-140, Form I-485, and others, for the first time in six (6) years. The new fees will become effective on December 23, 2016 so you may continue to file with current filing fees until that date.

Changes in the new fee schedule can be found here. The new fees are also listed on the Form G-1055, Fee Schedule, which is published on the USCIS website. Some of the more relevant fee increases are as follows:

·         Form I-129:     New fee of $460 (currently $325)

·         Form I-130:     New fee of $535 (currently $420)

·         Form I-131:     New fee of $575 (currently $360)

·         Form I-140:     New fee of $700 (currently $580)

·         Form I-485:     New fee of $1,140 (currently $985)

·         Form I-765:     New fee of $410 (currently $380)

·         Form N–400:   New fee of $640 (currently $595)

According to USCIS, this increase is necessary to maintain adequate service to its customers and to also recover the full cost of services provided by USCIS. These include the costs associated with fraud detection and national security, customer service and case processing, and providing services without charge to refugee and asylum applicants and to other customers eligible for fee waivers or exemptions.

Please note that the new filing fees will go into effect on December 23, 2016. On or after December 23, 2016, all applications or petitions mailed, postmarked, or otherwise filed to USCIS, must include the new filing fee(s) or USCIS will not be able to accept them. This will be particularly important to applications being filed on or around that date with status expiration dates.
