$100,000 H-1B Fee Update: What We Know

Here's the latest from USCIS regardng the $100,000 H-1B fee imposed by the Presidential Proclamation of September 19, 2025:

- The fee applies to:
* New H-1B petitions filed after September 21, 2025, for beneficiaries located outside the U.S. requesting consular, port of entry, or pre-flight inspection notification
* H-1B petitions filed after September 21, 2025, requesting change of status, amendment, or extension if USCIS denies the amendment, change, or extension of status request

- The fee does not apply to:
* H-1B petitions filed before September 21, 2025
* Holders of previously issued and currently valid H-1B visas
* Beneficiaries of approved H-1B petitions filed after September 21, 2025 requesting amendment, extension, or change of status in the U.S.
* Beneficiaries of approved H-1B petitions filed after September 21, 2025 requesting amendment, extension, or change of status who subsequently depart the U.S. and apply for an H-1B visa abroad
* Beneficiaries of the national interest exception to the $100,000 payment (exception must be granted before filing the H-1B petition by submitting request and supporting evidence to H1BExceptions@hq.dhs.gov)

- Payment of the $100,000 to be submitted at https://www.pay.gov/public/home prior to filing
